This happens more then you would think, people on a break at work and they are injured. The question is can they still make a work accident compensation claim? I think the answer depends a great deal on many items to be discussed. Let me reiterate that I am not a lawyer and this is for discussion only, if you are injured at work, always report it no matter what the circumstances are.
Some Of The Questions
So much of this depends on where you live and the local laws regarding work place injury and the company policy regarding theses situations. But you might be asked:
- Does the company have a designated area for breaks and if they do were you in that area?
- What were you doing when you were injured? Were you walking and had a slip and fall on either a wet area or tripped over something? Were you horsing around with one of your friends and that was the cause of a fall or injury?
- What was the injury and exactly how did it happen? This is somewhat like the previous question but will probably be the crux of the matter.
- Were you violating any other policies such as smoking in a non-smoking area and was the injury caused by trying not to get caught?
- Do you have non-friend witnesses that can back you in that you were following all the rules?
- Did you report it right away and if not, why not?
Again, in many places and jurisdictions it won’t matter what the circumstances were because some places are very broad in their interpretation of the workplace compensation rules. And then there are other jurisdictions that take a completely different view and require workers to follow a much more stringent set of rules to be covered. You probably know how the area that you live in is in such matters.
